DEBTOR'S MOTION TO VACATE THE ORDER DISMISSING CASE
AND VACATE THE ORDER DENYING CONFIRMATION

NOW COME, THE DEBTOR, JOE DEBTOR, by and through the law offices of DAVID M. SIEGEL, and states as follows:

1. That on 3/3/00, the Debtor filed a voluntary petition for relief pursuant to Chapter 13 under Title 11 USC.

2. That Elaine Jensen was appointed Trustee in this case.

3. That confirmation was denied on April 24, 2000.

4. That Amended Schedules A, C, D, and J were filed with the clerk on May 2, 2000.

5. That confirmation was denied for failure to make timely amendments.

6. That Debtor was current with his trustee payments and is prepared to be current at the date of hearing this Motion.

7. That the Debtor's case was dismissed on May 22, 2000.

8. That the Debtor is substantially current with the Trustee and all remaining issues involving confirmation should have been resolved.

WHEREFORE, the Debtor, JOE DEBTOR, prays that this Honorable Court enter an Order vacating the previous Order of May 22, 2000, which dismissed the case, and for an Order vacating the Order of 4-24-00 denying confirmation and for such other and further relief the Court deems just and proper.
