FOR THE NORTHERN DISTRICT OF ILLINOIS, EASTERN DIVISION

IN RE:
JOSEPH DEBTOR

DEBTOR'S MOTION TO VACATE DENIAL OF CONFIRMATION AND FOR HEARING ON CONFIRMATION INSTANTER

NOW COMES, THE DEBTOR, JOSEPH DEBTOR, by and through her attorney, DAVID M. SIEGEL, and states as follows:

1. That on 12/4/98, the Debtor filed a voluntary petition for relief pursuant to Chapter 13 under Title 11 USC.

2. That Jack McCullough was appointed Trustee in this case.

3. That confirmation was denied on 3/17/99.

4. That all necessary documents have been filed in this case and that Debtor is current on all Trustee payments. That an Amended Plan was filed to increase the Plan Payment to $450.00 per month.

WHEREFORE, the Debtor, JOSEPH DEBTOR, prays that this Honorable Court enter an Order vacating the Order of 3/17/99 denying confirmation and that a hearing on confirmation be heard instanter.
