IN THE MATTER OF:

DEBTOR

DEBTOR

MOTION TO EXCUSE DEBTOR FROM 341 EXAMINATION

NOW COMES the Debtor, by and through her attorney, DAVID M. SIEGEL, and in support of her Motion, states as follows:

1. That DEBTOR is a Joint-Debtor for the above captioned case.

2. That the 341 examination was held on November 4, 1997 and that joint-debtor was present and examined.

3. That the other joint-debtor was not present due to severe illness.

4. That Debtor has terminal cancer and is unable to leave her home for any period of time.

5. That said debtor's breathing is being supported by an oxygen tank in her home.

6. That the Trustee has no objection to Debtor's presence being waived.

7. That the Trustee concluded the 341 meeting with a finding of no assets.

8. That Sears was the only creditor that appeared and that a re-affirmation agreement was signed.

9. That no creditor would be prejudiced by excusing debtor.

WHEREFORE, Debtor respectfully requests that this honorable court grant Debtor's Motion to Excuse Debtor from 341 Examination.
